1. Acceptance of Terms

By accessing or using The Smartest Email ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service provided by Happenings Group A/S ("Company", "we", "us", or "our"), a company registered in Denmark with CVR number 40979956.

2. Description of Service

The Smartest Email is an AI-powered email management platform that provides:

• Intelligent email categorization and analysis using artificial intelligence
• One-click unsubscribe functionality from mailing lists
• Email analytics and insights
• Thread grouping and conversation tracking
• Integration with Gmail via OAuth 2.0

The Service accesses your Gmail account with your explicit permission to provide these features. We do not send emails on your behalf without your explicit action.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 16 years of age
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• You have a valid Gmail account that you own or have permission to access

4. User Accounts

Account Creation: You create an account by signing in with your Google account via OAuth 2.0. We never see or store your Google password.

Account Security: You are responsible for maintaining the security of your Google account. You can revoke our access to your Gmail account at any time through your Google account settings.

Account Termination: You may delete your account and all associated data at any time through the Service settings. We will permanently delete all your data within 30 days of account deletion.

5. Privacy and Data

Data Collection: We collect and process your email data solely to provide the Service. This includes email metadata, content, and AI-generated analysis.

Data Security: We use industry-standard AES-256-GCM encryption to protect your data. All data is stored on secure MongoDB Atlas infrastructure with encryption at rest.

Data Usage: Your email data is used to:

• Provide AI-powered email analysis and categorization
• Generate insights and analytics about your email patterns
• Improve our AI models (aggregated and anonymized data only)

Data Sharing: We never sell, rent, or share your email data with third parties for marketing purposes. We only share data with service providers necessary to operate the Service (e.g., hosting, AI processing) under strict confidentiality agreements.

6. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction (including but not limited to copyright laws)
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use the Service to send spam or unsolicited communications
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service without permission

7. Intellectual Property

Our Property: The Service and its original content (excluding user data), features, and functionality are owned by Happenings Group A/S and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain all rights to your email data. By using the Service, you grant us a limited license to access, store, and process your data solely to provide the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF AI ANALYSIS
• UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that the Service will be available at all times or that it will be free from viruses or other harmful components.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAPPENINGS GROUP A/S SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your data

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS, OR €100, WHICHEVER IS GREATER.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting a notice on our Service or by sending you an email.

Your continued use of the Service after any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts of Aarhus, Denmark.
